Revised Terms of Use
Terms of Use Effective Date: February 10, 2026 (Update to today's date or when posted)
1. Acceptance of Terms By accessing or using brattys.cc (the “Platform,” “Website,” or “Web Application”), you agree to be legally bound by these Terms of Use (“Terms”). These Terms govern your rights and obligations with respect to brattys. If you do not agree, you must immediately stop using the Platform. Continued use constitutes your acceptance. We may modify these Terms at any time; changes take effect upon posting on the Platform. Review them periodically.
2. Eligibility The Platform is for individuals aged 18 and older only. By using it, you confirm you are at least 18, capable of entering binding contracts under applicable law, and not barred from using it. If acting for a company or entity, you warrant you are authorized to bind it. We do not knowingly collect data from anyone under 18. If we learn of such data, we will delete it. Parents/guardians discovering unauthorized child data should contact us immediately.
3. Account Registration To access features, create an account with accurate information (e.g., name, email, username, password). Keep credentials confidential and notify us immediately of unauthorized access. You are fully responsible for all account activity. We are not liable for losses from unauthorized use.
4. User Content and Pages Users may create pages to offer and sell their own digital products (e.g., online courses, podcasts, written guides) or manage privacy-focused gift wishlists featuring items from partner brands and e-commerce stores (e.g., Amazon, Shopify). All pages must provide accurate, transparent descriptions of offered products/services. You are solely responsible for your content, compliance with laws, and any representations made. Misleading information, fraud, or violations result in immediate suspension/termination. The Platform facilitates e-commerce transactions only—no peer-to-peer transfers, tips, donations, fundraising, or charitable contributions are permitted.
5. Payments and Stripe Integration Payments are processed exclusively via the third-party processor Stripe, subject to Stripe's Terms of Service. To receive funds, link a valid bank account to Stripe and comply with their requirements. We do not process payments directly and disclaim liability for transaction failures, chargebacks, delays, disputes, or losses. All transactions are standard e-commerce purchases of digital products or wishlist items.
6. Prohibited Activities and Content (New/Expanded Section) You may not use the Platform for:
- Adult, sexually explicit, pornographic, or mature content (including literature, imagery, media, or services designed for sexual gratification), even if age-gated or marked "18+".
- Illegal activities, fraud, hate speech, harassment, violence, child exploitation, gambling, drugs, weapons, or any prohibited/restricted items under applicable laws or Stripe's Prohibited and Restricted Businesses list.
- Tips, donations, fundraising, peer-to-peer money transmission, or any non-product payments.
- Content that violates intellectual property, privacy, or consumer protection laws. We actively moderate content and reserve the right to review, remove, or suspend anything non-compliant. Violations may lead to account termination and reporting to authorities.
7. Intellectual Property and Licenses You retain ownership of your content but grant us a limited, worldwide, non-exclusive license to host, display, and facilitate sales of it on the Platform. We own all Platform elements (design, software, trademarks).
8. Account Suspension and Termination We may suspend or terminate accounts for violations, suspected fraud, or to protect the Platform. You may request deletion; we will remove public data but retain records as required by law.
9. Disclaimer and Limitation of Liability The Platform is provided "as is" without warranties. We disclaim liability for interruptions, errors, data loss, or third-party actions (including Stripe). Our total liability is limited to fees paid in the prior 12 months (if any). You assume all risks.
10. Changes to Terms We may update these Terms without notice. Continued use after changes constitutes acceptance. Check regularly.
11. Governing Law and Jurisdiction These Terms are governed by the laws of England and Wales. Disputes shall be resolved exclusively in the courts of Manchester, United Kingdom.
